Article 135. (1). Whoever intentionally causes the miscarriage of a woman’s fetus is deemed to commit the crime of abortion, unless such miscarriage occurs in one of the following situations:
(a) if the miscarriage is necessary to protect the life of the mother;
(b) if the pregnancy is the result of rape and is of less than ninety days’ duration and the mother requests the miscarriage; or
(c) if it is proven that the fetus is dead in its mother’s womb.
(2) Whoever commits the crime of abortion shall be punished with imprisonment for a period that shall not exceed three years or with a fine, or both, without prejudice to the right to compensation.
Article 136. Whoever, knowing that a woman is pregnant, commits an act that causes her to abort shall be punished with imprisonment for a period that shall not exceed one year or with a fine, or both, without prejudice to the right to compensation.
Article 137. Whoever commits an act that results in the death of a fetus in its mother’s womb or causes it to be born dead or die after its birth when such an act is not necessary to protect the mother’s life or protect her from serious injury shall be subject to imprisonment or a fine or both, without prejudice to the right to compensation
