ARUBA. Penal Code.
Article 308. A woman who intentionally causes the abortion or death of her fetus or lets another person cause it shall be punished with up to three years’ imprisonment.
Article 309. (1) Whoever intentionally causes the abortion or death of the fetus of a woman without her consent shall be punished with up to twelve years’ imprisonment.
(2) If this act results in the death of the woman, he shall be punished with up to fifteen years’ imprisonment.
Article 310. (1) Whoever intentionally causes the abortion or death of the fetus of a woman with her consent shall be punished with up to four years’ and six months’ imprisonment.
(2) If this act results in the death of the woman, he shall be punished with up to six years’ imprisonment.
Article 311. If a physician, midwife, or apothecary is medeplichtig of the offense described in Article 308 or guilty or medeplichtig of one of the offenses described in Articles 309 and 310, the punishments provided for in the Articles shall be increased by one third and he or she can be prohibited from carrying out the profession within which he or she performed the offense..
